Terms of sale
Last updated 14 January 2026. These terms apply to every order placed with Pearlmoth Lacquer Co..
1. The seller
Goods are sold by Pearlmoth Lacquer Co., a company registered in Oregon and trading as PEARLMOTH.
2. Batch variation
Every bottle is hand filled from a numbered pour. Small variation between pours of the same shade is a property of the product, not a defect, and is not grounds for return under clause 5. The batch code on the base identifies the pour and we hold the written record of each one.
3. Prices and availability
Prices are in United States dollars and include the bottle, carton and label. A shade shown on the index is not a guarantee of stock; where a pour has sold through, the listing says so rather than accepting the order.
4. Despatch
Orders are packed on Tuesdays and Fridays, normally within four working days. Lacquer ships by ground service only, within the United States and to Canada. Air freight is not available for these goods.
5. Returns
Unopened bottles may be returned within thirty days of delivery for a refund of the goods. Opened bottles cannot be returned, since the contents cannot be resold. Where a bottle arrives damaged, broken or leaking, send a photograph and the batch code and we will replace it or refund it, including postage.
6. Retired shades
Where a pigment is discontinued a shade is marked as a final pour, sells through, and is not reissued under the same name with a different formula. Nothing in these terms obliges us to reproduce a retired shade.
7. Wholesale
Stockists buy direct on the terms sheet current at the time of the order. Minimum quantities, payment terms and the position on returns differ from retail orders and are set out in that sheet.
8. Liability
Our liability for any order is limited to the value of the goods supplied. Nothing here limits liability that cannot be limited by law.
9. Governing law
These terms are governed by the law of the State of Oregon, and the courts of Oregon have jurisdiction.
